Fundraising Terms of Agreement

I wish to fundraise for Ronald McDonald House Charities Greater Western Sydney (RMHC GWS).

This agreement applies to my Fundraiser and any other related event(s) in which I engage to raise funds for RMHC GWS. By agreeing to the Fundraising Terms of Agreement, I accept that these are the terms that form the basis of my fundraising and dealings with RMHC GWS.

Responsibilities of Fundraiser

I understand that if I am under the age of 18, I must have my guardian approve my participation.

I assert and confirm that my participation in my fundraiser is voluntary.

I acknowledge that the fundraiser is my sole responsibility. I understand that RMHC GWS is not able to take a coordination role in these activities and its employees, volunteers, or other personnel cannot assist in soliciting prizes, organising publicity, or providing goods or services to assist in the running of the fundraiser. 

I assert that my fundraiser will meet the requirements of relevant State and Territory laws and regulations. I understand that the information provided to RMHC GWS must be available to regulatory authorities on request. I acknowledge that RMHC GWS does not provide legal advice regarding compliance with these laws and regulations.

I am aware of and expressly assume all risks associated with holding my fundraiser. I understand that RMHC GWS is unable to provide public liability insurance to cover my fundraiser. I agree to release, indemnify and hold harmless RMHC GWS and any related parties for all claims and actions whatsoever which may be made by me, on my behalf or in respect to my fundraiser. I understand that I cannot make a claim against RMHC GWS or its employees, volunteers, or other personnel, for any damage, loss, injury and/or death arising at or from the fundraising activity outlined in this agreement.

I agree that my participation in my fundraiser is at the sole discretion of RMHC GWS and/or the organiser, and that my participation may be limited or terminated with or without cause.

Authority to fundraise

Regulation and best practice in Australia dictate that any person or organisation fundraising must have an ‘authority to fundraise’.

I understand that I am not authorised to use RMHC GWS as my beneficiary charity until I have received an authorisation letter from RMHC GWS.

The 'authority to fundraise’ will be sent by Ronald McDonald House Charities Greater Western Sydney after:

  • RMHC GWS are satisfied that the fundraiser/event will produce a reasonable return after expenses have been deducted;
  • RMHC GWS are satisfied that the fundraising activity fits in with the aims and values of Ronald McDonald House Charities Greater Western Sydney; and
  • RMHC GWS are satisfied the fundraising activity is not high risk.

Promotion of Fundraiser & RMHC GWS

I understand that all material with which the RMHC GWS name and logo is to be associated must first be approved by RMHC GWS. I acknowledge that to utilise the RMHC GWS name and/or logo on any materials or products, I must obtain prior written permission from RMHC GWS.

I understand that:

  • Permission to use the logo must be requested 
  • any materials, pamphlets, brochures or products must be submitted to RMHC for approval
  • any printed materials, such as a media release, must be pre-approved by RMHC GWS
  • any printed materials must be forwarded to RMHC GWS for approvals prior to being printed or circulated

I acknowledge that without authority from RMHC GWS to fundraise, I am not permitted to identify RMHC GWS as a charity associated with my fundraiser, in promotion or through the use of other materials.

 

Types of Fundraisers

I understand that due to the nature of RMHC GWS and the high ethical standards under which they operate, there are some events with which they cannot be associated. I understand that my fundraiser should fit with the aims and values of RMHC GWS and not be deemed as high risk.

I understand that my event cannot involve:

  • extreme sports such as parachuting, paragliding or bungy jumping,
  • motor vehicle and motor bike racing and activities that involve marine racing unless I provide evidence of public liability insurance to cover myself and my participants; 
  • gambling;  
  • games of chance that do not comply with State legislation; 
  • activities of a sexual nature; or 
  • activities that promote harm to self, animals, or the environment.

I acknowledge that RMHC GWS reserves the right to deny any and all fundraising activities or events, including those that are not listed above. 

Finance, records and receipting

I acknowledge that the financial aspects of fundraising, raffles, record keeping, and management of the fundraiser/event are entirely my responsibility, and I must comply with the relevant State or Territory laws and regulations. 

The following is a summary of financial reporting typical of that required from Community Fundraisers which is needed to protect the public interest: 

  • set-up and maintain proper financial records and accounts which can be audited if necessary; 
  • if requested, provide RMHC GWS at the outset with an accurate estimate of expenses and the likely proceeds of the fundraiser/event; 
  • where necessary/appropriate, set up a separate bank account that mentions Ronald McDonald House Charities Greater Western Sydney’s name. All funds are to be banked into this separate bank account. This account must be closed after my event; 
  • money raised and details of my actual income and expenditure must be returned to RMHC GWS within four (4) weeks of the fundraising activity; and 
  • RMHC GWS cannot pay expenses incurred by me, but I can deduct my necessary expenses from the proceeds of my event, provided they are properly documented. (Total expenses must be less than 40% of total proceeds).

I understand that Ronald McDonald House Charities Greater Western Sydney can provide official receipts for approved events. Tax-deductible receipts can only be issued to people donating money of $2 or more.??As the fundraiser, I must keep a register of all supporters who require a tax-deductible receipt.

I acknowledge that it is my responsibility to understand the circumstances when a receipt can be issued, and to requirement to reconcile funds. The following are not tax-deductible:

  • Ticket purchases (eg. raffle),
  • Entry to an event,
  • Donations of goods or services,
  • Auction purchases, or purchase of a device.

I have read the RMHC GWS Fundraising Terms of Agreement, and I agree to conduct my fundraising event in accordance with these terms, and in a manner which upholds the integrity, professionalism, and values of Ronald McDonald House Charities Greater Western Sydney.
